Last week, I wrote an article about trademarks, copyrights and the magician.
I warned that Brad Ross is promoting a school show called "Mission Nutrition" to the magic community. He is offering a license to magicians to perform "Mission Nutrition." Unfortunately, Mission Nutrition © 2007, is a Trademark of the Kellogg Company used under license by Kellogg Canada Inc.
I had previously contacted Brad Ross about this, but he chose not to answer my inquiry. I don't know what his intent is, but I am giving him the benefit of the doubt. Brad is not the creator of the program, but he should look into things before he promotes them. At the least, you would think he would have concern over whether he was promoting a product that could get his customers into legal trouble.
Jason Hurdy, one of the co-creators of "Mission Nutrition", has contacted me to let me know that he and his partner, Matt James, have changed the name of their program. The change is minor, it is now Mission: Nutrition, but is no longer infringing. I appreciate Jason's integrity. We need more of that in the magic business.
I have a great deal of respect for Jason. He was bright enough to see that this was a legitimate concern.
Matt had actually done a trademark search before releasing the program, and believed the name was not trademarked. It is a protected name in Canada, but possibly not in the United States. So kudos to Matt for doing his research. He may or may not have dug deep enough, but he was smart enough to at least investigate.
I have seen Jason's video of the program, and I must say, it looks very good.
So to my readers, I continue my warning: do not buy programs off the shelf without doing your own research. On the other hand, I believe Jason Hurdy and Matt James to be honest and trustworthy.
